Nais bigyan ng ngipin ng isang kongresista ang Department of Agriculture (DA) para mapalakas ang kampanya laban sa mga sangkot sa agricultural smuggling.
Ayon kay House Ways and Means chair at Albay Rep. Joey Sarte Salceda, isinusulong nito na bigyang kapangyarihan ang pagpapatupad ng batas sa agricultural smuggling sa pamamagitan ng paglikha ng Agricultural Trade Intelligence and Investigation Service (ATIIS) ng DA na katumbas at makakatulong ng Customs Intelligence and Investigation Service ng Bureau of Customs (BoC).
Sa sulat na ipinarating ni Salceda kina DA Secretary William Dar at DA Undersecretary Fermin Adriano, hiniling nito na gawing pormal ang kahilingan ng mga ito para sa police powers, na una nang binanggit ni Dar, sa pamamagitan ng pagpapadala ng draft ng panukalang batas at mga input ng DA sa nasabing usapin.
“I have already taken the initiative and we are filing that measure. But I also want DA to see what works best given their hierarchy and needs,” ani Salceda.
Ginawa ng kongresista ang kahilingan sa gitna ng mga ulat na P300 bilyon ng mga produktong palm oil ang illegal o smuggled ang ipinasok sa merkado ng Pilipinas.
Ang technical smuggling ng palm oil products ay ginagawa umano sa pamamagitan ng pagdedeklara ng mga import na crude palm oil ay angkop para sa animal consumption, na hindi napapatawan ng Value-Added Tax.
Sinabi ni Salceda na bibigyan ng kapangyarihan ang ATIIS na magsagawa ng pagsisiyasat, hulihin ang mga nagkasala at kumpiskahin ang mga technically smuggled agricultural products gayundin ang pakikipagtulungan sa customs enforcement.
Papayagan din itong magsampa ng kaso laban sa sinumang mahuhuling smugglers ng paglabag sa Republic Act No. 10845 o ang Anti-Agricultural Smuggling Act of 2016.
“The problem with RA 10845 is that, although it classifies large scale agricultural smuggling as economic sabotage, the teeth and the strong arm to enforce the law are not specified. The Bureau of Customs is made the lead implementing agency, but even its prosecutorial or enforcement powers are not elaborated enough,” sabi pa ni Salceda.
“I also want the DA unit to work with a strengthened Customs Intelligence and Investigation Service. That will help close the loopholes technical smugglers exploit,” dagdag pa nito.
Sinabi pa ni Salceda na ang pagbibigay sa DA ng isang unit na may police powers upang ipatupad ang anti-smuggling laws ay malaking tulong para masawata ang pagpasok ng mga imported na produkto sa bansa ngunit smuggled.
“It adds another layer of protection from smuggled goods, for our domestic agriculture sector. The unit will also help address the concerns of the DA that the Department of Justice may not have the bandwidth to expeditiously pursue cases filed on agricultural smuggling,” paliwanag pa ng kongresista.
