DOLE sa private sector: Magbayad ng dagdag 30% pay sa empleyadong papasok ngayong May 9

Nagpaalala ang Department of Labor and Employment (DOLE) sa mga pribadong sektor na ibigay ang 30 porsiyentong dagdag sahod ng mga manggagawa nitong papasok sa trabaho sa Mayo 9, araw ng Lunes na panahon ng eleksyon.

Ayon sa DOLE, ito ay matapos ilabas ni Pangulong Rodrigo Duterte ang Proclamation No. 1357 na nagdedeklara sa May 9, 2022 national and local elections bilang Special (Non-Working) Holiday.

 “We highly encourage our workers who are registered voters to exercise their rights to suffrage, and if they will report to work on May 9 after casting their votes, they must receive an additional 30 percent in their daily pay,” sabi ni Labor Secretary Silvestre H. Bello III.

Sa ilalim ng Labor Code’s Chapter III, Article 94, o ang right to holiday pay, ang wage rules para sa Special (Non-Working) Holiday ay ipapatupad kung ang empleyado ay hindi pumasok sa trabaho, ang “no work, no pay” principle ang ipatutupad kung walang sinusunod na company policy, practice, o collective bargaining agreement (CBA) sa pagkakaloob ng dagdag bayad sa special day.

Samantala, ang mga empleyado namang papasok ay makakatanggap ng 30 porsiyento sa kanilang basic wage sa unang 8-oras na pagtatrabaho.

“For work done more than eight hours (overtime work), they shall be paid an additional 30 percent of their hourly rate on the said day [hourly rate of the basic wage x 130% x 130% x number of hours worked],” ayon sa DOLE.

“If employees work on a special day that also falls on their day off, they shall be paid an additional 50 percent of their basic wage on the first eight hours of work [(basic wage x 150%) + COLA]. For overtime work on a special day that also falls on their rest day, they shall be paid an additional 30 percent of their hourly rate on the said day [Hourly rate of the basic wage x 150% x 130% x number of hours worked],” dagdag nito.

Pinayuhan ni Bello ang mga manggagawa na magsumbong sa DOLE Hotline 1349 o sa pinakamalapit na DOLE office kung mahaharap sa underpayment at non-payment ng takdang sahod.
