Libreng tulong-legal sa military at uniform personnel isinulong sa Kamara

Inihain ni Leyte 1st district Rep. Martin G. Romualdez ang panukalang batas na magbibigay ng free legal assistance sa militar and uniformed personnel (MUPs) na may kinakaharap na kaso na may kaugnayan sa trabaho ng mga ito.

Sa House Bill (HB) No. 8 na Inihain ni Romualdez at co-sponsor sina Ilocos Norte Rep. Ferdinand Alexander Marcos at Tingog party list Reps. Yedda Marie K. Romualdez at Jude Acidre, sakop nito ang mga uniformed personnel ng Armed Forces of the Philippines (AFP) at Philippine National Police (PNP). 

Gayundin ang mga tauhan ng Bureau of Fire Protection (BFP), ng Bureau of Jail Management and Penology (BJMP), at ang Philippine Coast Guard (PCG) na kabilang din sa depenisyon ng MUP sa ilalim ng umiiral na batas.

Anila, ang free legal assistance benefit ay para sa mga MUP na may mga nakabinbing kaso sa prosecutor’s office, mga korte, o anumang quasi-judicial o administrative body.

“By providing free legal assistance under this measure, our MUPs who sacrifice their life and limb for the preservation of our national security, public order, and public safety will be able to perform their sworn duties without fear of unwarranted cases filed against them for the purpose of harassment or reprisal,” nakasaad sa panukala.

“Hence, this bill will provide free legal assistance to all offices or uniformed personnel of the AFP, PNP, BJMP, BFP, and PCG in all stages of criminal, civil, or administrative proceedings arising from service-related incidents, including retired MUPs who had cases or charges involving service-related incidents while still in active duty,” dagdag nito.

Sakaling maging batas, tatawagin ang panukala bilang “Free Legal Assistance for Military and Uniformed Personnel Act”. 

Ang free legal assistance ay  ang mga sumusunod 1. Legal na representasyon sa lahat ng yugto ng sibil, kriminal, o administratibong mga kaso na kinasasangkutan ng mga insidente na may kaugnayan sa serbisyo;  2. Legal na payo o konsultasyon kaugnay ng mga kaso o insidente na may kaugnayan sa serbisyo;  3. Paghahanda ng mga pleading, mosyon, memorandum, at lahat ng iba pang legal na anyo at dokumento kaugnay ng mga kasong may kaugnayan sa serbisyo;  4. Notarisasyon ng mga dokumento kaugnay ng mga kaso na may kaugnayan sa serbisyo;  at 5. Lahat ng iba pang ligal na serbisyo at gawain ayon sa direksyon ng chief of staff ng AFP, ng hepe ng BFP, ng hepe ng BJMP, ng commandant ng PCG, o ng hepe ng PNP.
