Nanindigan ang ilang kongresista na dapat nang irehistro ang lahat ng postpaid at prepaid mobile phone
subscriber identity module (SIM) cards upang malabanan ang mga nagkalat na scammers at iba pang criminal activities.
Sinabi ni Leyte 1st District Rep. Martin G. Romualdez na sa kasalukuyan ay tanging ang mga SIM cards sa postpaid mobile o cellular phone subscriptions ang inoobligang irehistro.
Sa House Bill 14 o SIM Card Registration Act na inihain ni Romualdez at ng mga co-authors na sina Ilocos Norte Rep. Ferdinand Alexander Marcos, at Tingog party list Reps. Yedda Marie K. Romualdez at Jude Acidre, layon nito na obligahin ang pagpaparehistro ng lahat ng SIM cards upang mawala na ang nangyayaring krimen gamit ang mobile phone.
“This bill seeks to require ownership registration of SIM cards to eradicate mobile phone-aided criminal activities,” paliwanag sa HB No. 14.
Paliwanag pa ng mga kongresista na dahil sa madaling nabibili ang SIM cards sa murang halaga na P30 sa mga sari-sari o convenience store at posibleng nagagamit ito sa paggawa ng panloloko.
Binanggit din ng mga kongresista na base sa 2020 World Bank report, ipinapakita na na mayroong 137 cellular phone subscriptions sa bawat 100 Filipinos, na nagpapahiwatig na maraming Filipino ang may higit pang isang subscription o mobile phone.
“On the other hand, having an unregulated SIM card market has also given way to several mobile phone scams. The cases range from simple text messages asking users to send cellular loads, to more sophisticated voice phishing methods and marketing spams that are used to gain unauthorized access to sensitive personal information of unsuspecting mobile phone users,” paliwanag pa sa panukala.
Nabatid na bagama’t milyun-milyon nang text messages ang naharang na ng cellular phone service provider dahil sa mga reklamo ng mga subscribers, patuloy pa ring nangyayari ang mga illegal na transakyon.
“Furthermore, due to the lack of SIM card registration, it becomes nearly impossible to trace the persons behind the text scams and hold them accountable for fraud, breach of data privacy or other punishable offenses that they committed using an unknown mobile number,” ayon pa sa panukala.
Giit ng mga mambabatas, panahon nang i-regulate ang pagbebenta at pagpapakalat ng SIM cards upang maisulong ang pananagutan ng end-user, maiwasan ang paglaganap ng mobile phone scams at data breaches, at tumulong sa mga awtoridad sa pagresolba ng krimen na kinasasangkutan ng paggamit ng mobile phone units.
Sa ilalim ng HB 14, ang mga public telecommunications entity (PTE) o authorized seller ay kinakailangang obligahin ang end user na lumagda ng tatlong beses sa numbered registration form na inilabas ng PTE.
Nakasaad pa sa panukala na sinumang lalabag dito ay mahaharap sa parusa at multa.
“If the offense is committed by a PTE, the president and other responsible officers shall be held liable and fined up to P300,000 for the first offense, up to P500,000 for the second offense and up to P1 million for the third and any succeeding violation. If the violator is an authorized seller, his operation shall be suspended and a fine of P5,000 to P50,000 shall be imposed,” ayon sa panukala.
“If the offender is an officer or employee of an implementing agency, he shall be dismissed from the service and fined, without prejudiced to the filing of appropriate criminal, civil and administrative charges,” dagdag pa nito.
