Inaprubahan na ng Mababang Kapulungan ng Kongreso sa ikatlo at huling pagbasa ang panukalang mag-aamiyenda sa BI Modernization Act.
Sa 287 boto pabor, inaprubahan ng Kamara ang House Bill (HB) No. 8203, o ang BI Modernization Act, na naglalayong gawing propesyonal ang mga tauhan nito.
“This bill’s importance cannot be overstated, being one of the listed Legislative Executive Development Advisory Council (LEDAC) bills. It
is two-pronged in that it will improve travel experience and at the same time tighten up our border security,” sabi ni House Speaker Ferdinand Martin G. Romualdez.
“This measure is also a long time coming, as it has been filed and re-filed for around 20 years. A lot of technologies have changed in that span of time and this bill ushers the BI into the digital age,” dagdag nito.
Sinasabi ng panukala na walang tao ang dapat italaga sa posisyon ng immigration officer maliban kung ang taong ito ay nakakatugon sa mga pamantayan ng kuwalipikasyon na itinakda ng BI at inaprubahan ng Civil Service Commission (CSC).
Ang BI ay attach-agency ng Department of Justice (DOJ) ang nagpapatupad ng local immigration, citizenship, at alien admission and registration laws.
Bilang karagdagan sa mga internasyonal na paliparan at daungan, dapat na itatag ang mga checkpoints sa pagkontrol sa hangganan na dapat pangasiwaan ng mga opisyal ng BI na itinalaga bilang border control officers ng BI commissioner.
Kabilang sa mga naghain ng panukala si House Minority Leader at 4Ps party-list Rep. Marcelino Nonoy” Libanan, na dating BI commissioner noong termino ni dating Pangulo at ngayo’y Deputy Speaker at Pampanga 2nd District Rep. Gloria Macapagal-Arroyo.
Gayundin, ang iba pang principal authors sina Reps. Elpidio “Pidi” Barzaga, Stela Luz Quimbo, Sonny Lagon, Daphne Lagon, Juliet Marie de Leon Ferrer, Rufus Rodriguez, Jurdin Jesus Romualdo, Gus Tambunting, at iba pa.
Kabilang sa mga pangunahing probisyon ng HB No.8203 ay ang kakayahan ng ahensya na panatilihin ang Immigration Trust Fund (ITF) na hindi hihigit sa P1.2 bilyon mula sa taunang kita nito na nagmula sa mga bayarin, multa, at mga parusa.
Gagamitin ang pera para pondohan ang mga proyekto ng information technology (IT) ng BI, bukod sa iba pang mga plano sa modernisasyon, at para buuin ang kakayahan ng mga opisyal ng BI.
“The ITF shall be managed by the Board in accordance with existing government auditing rules and regulations, and shall be used exclusively for the following: a) 50 percent for the modernization of equipment, facilities and offices used by employees of the bureau, including capital outlay for the establishment of new buildings and field offices for the effective implementation of this Act; b) 30 percent for the payment of employee benefits provided in this Act, and as may be hereafter provided by the Board with the approval of the Secretary of Justice; and c) 20 percent for the further professionalization of the employees of the bureau including trainings, seminars and other career advancement programs,” ayon sa panukala.
Upang maakit ang mga kwalipikadong kawani, ang suweldo na itatalagang junior immigration officer ay tataas din ng dalawang antas sa ilalim ng panukala.
Ang mababang suweldo ay tinukoy bilang pangunahing dahilan ng pagkabakante ng 742 sa 2,795 na awtorisadong permanenteng posisyon ng BI.
Nakapaloob din sa panukalang batas na magbibigay ng mga karagdagang benepisyo sa mga empleyado nito, partikular sa 1) night shift differential, na sasailalim sa Republic Act (RA) No. 11701; at 2) overtime pay para sa aktwal na trabahong ginawa alinsunod sa mga umiiral na tuntunin at regulasyon.
