Special election sa Negros Oriental iginiit ng Kamara sa Comelec

Pinagtibay ng Mababang Kapulungan ng Kongreso ang resolusyon na nananawagan sa Commission on Elections (Comelec) na magsagawa ng special election sa Negros Oriental.

Sa House Resolution No. 1212 na inihain nina Speaker Ferdinand Martin G. Romualdez, Majority Leader Manuel Jose “Mannix” M. Dalipe, at House Minority Leader Marcelino Libanan, hiniling ng mga ito sa Comelec na ang special election ay bunsod ng pagpapatalsik kay dating Negros Oriental 3rd District Rep. Arnolfo “Arnie” Teves.

Sa parehong panukala, sinertipikahan ng Kamara ang pagiging bakante ng congressional district ng lalawigan.

Sinabi ng mga may-akda na ang pagbakante sa ikatlong distrito ng Negros Oriental ay bunsod ng pagpapatalsik kay Teves kaugnay ng disorderly behavior at paglabag sa Section 141 (a) at (b), Rule XX ng Code of Conduct of the House of Representatives, na nakakuha ng kinakailangang boto ng lahat ng miyembro ng Kamara ayon sa itinatadhana ng Konstitusyon.

Anila, dahil sa pagiging bakante ay naiwan ang mga nasasakupan ng ikatlong legislative district ng lalawigan at walang representasyon sa Mababang Kapulungan ng Kongreso.

Iginiit ng mga ito ang Section 9, Article VI ng Konstitusyon na nagsasaad ng; “In case of vacancy in the Senate or in the House of Representatives, a special election may be called to fill such vacancy in the manner prescribed by law, but the senator or member of the House of Representatives thus elected shall serve only for the unexpired term.”

“In case a vacancy arises in the Senate at least 18 months or in the House of Representatives at least one year before the next regular election for members of Congress, the Commission on Elections, upon receipt of a resolution of the Senate of the House of Representatives, as the case may be, certifying to the existence of such vacancy and calling for a special election, shall hold a special election to fill such vacancy,” dagdag pa ng nasabing batas.

Ipadadala ng ng Kamara sa Comelec ang kopya ng The House resolved to send a copy HR No. 1212.

Una nang sinabi ni Comelec Chairman George Garcia na nakahanda na ang poll body para sa special election base sa kahilingan ng Kongreso.

“If we will be directed…we will comply with haste,” aniya pa.
