Nagpaalala ang Department of Labor and Employment (DOLE) sa mga employers na tiyakin na ipagkakaloob ng sa mga manggagawa ang nararapat na holiday pay sa panahon ng holidays sa buwan ng Oktubre at Nobyembre.
Sa nilagdaang DOLE Labor Advisory No. 24, Series of 2023 ni Secretary Bienvenido E. Laguesma noong Oktubre 12, tinukoy nito ang proper wage computation sa idineklarang special (non-working) days sa Oktubre 30, Nobyembre 1, at Nobyembre 2, gayundin ang darating na regular holiday sa Nobyembre 27.
Sa Proclamation No. 359, series of 2023, idineklara ang Oktubre 30 bilang special (non-working) day sa Barangay at Sangguniang Kabataan Elections habang sa Proclamation No. 42, Series of 2022, as amended ng Proclamation No. 90, Series of 2023, idineklarang holidays ang Nobyebre 2023.
Nakapaloob sa advisory, ang suweldo ng mga employees na magtatrabaho sa special (non-working) days sa Oktubre 30, Nobyembre 1, at Nobyembre ang mga sumusunod;
“If the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy, practice, or collective bargaining agreement granting payment on a special day,” ayon sa DOLE.
Para naman sa mga manggagawa na magtatrabaho sa special day, makakatanggap ito ng karagdagang 30 percent ng kanyang basic wage sa unang 8-oras.
“For work done over eight hours (overtime work), the employee shall be paid an additional 30 percent of the hourly rate on the said day (hourly rate of the basic wage x 130% x 130% x number of hours worked). If an employee works on a special day that also falls on a rest day, the employer shall pay an additional 50 percent of the basic wage on the first eight hours of work (basic wage x 150%),” ayon pa sa DOLE.
“For overtime work on a special day that also falls on the employee’s rest day, workers shall be paid an additional 30 percent of their hourly rate on the said day (hourly rate of the basic wage x 150% x 130% x number of hours worked),” dagdag pa nito.
Sa Nobyembre 27, na regular holiday, ang mga manggagawa na magtatrabaho ng 100 porsiyento ng arawang sahod o basic wage x 100%.
“When the day immediately preceding the regular holiday is a non-working day in the establishment or the scheduled rest day of the employees, they shall be entitled to holiday pay if they worked or were on leave of absence with pay on the day immediately preceding the non-working day or rest day,” sabi pa kalatas.
“For work done during the regular holiday, the employee shall be paid 200% of his/her wage for the first eight hours (basic wage x 200%). For overtime work, he/she shall be paid an additional 30 percent of his/her hourly rate (hourly rate of the basic wage x 200% x 130% x number of hours worked). If an employee works on a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her basic wage of 200 percent or (basic wage x 200% x 130%). For overtime work on a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30 percent of his/her hourly rate on the said day (hourly rate of the basic wage x 200% x 130% x 130% x number of hours worked),” base sa kautusan ng DOLE.
