Ipasa na ang HB 9153 — Rep. Barbers

Nanawagan si Surigao del Norte Rep. Robert Ace S. Barbers na agad ipasa ng Kamara ang House Bill No. 9153, na naglalayong wakasan ang pagdami ng mga ipinagbabawal na bagay sa loob ng lahat ng penal, custodial at detention facilities sa bansa.

Ayon kay Barbers, chairman ng House Committee on Dangerous Drugs, kailangan ang panukalang batas upang maipataw ng mga ahensya ng gobyerno ang kaukulang parusa sa mga tao at sindikato na patuloy na gumagawa ng mga ilegal na aktibidad sa loob ng correctional, detention at custodial facilities, lalo na ang mga convicted drug lords at hardened criminals na ginagamit ang mga pasilidad na ito bilang kanilang sarili at protektadong kaharian para sa mga gawaing kriminal kahit na nakakulong.

“HB No. 9153 principally aims to prevent the proliferation of contraband in prison by mandating all government agencies and local government units that operate and maintain any correctional, custodial or detention facility to establish and implement a Contraband Detection and Control System (CDCS),” sabi ni Barbers.

Sa ilalim ng “An Act Mandating all Correctional, Custodial and Detention Facilities to Implement a Contraband Detection and Control System, and Providing Penalties For Possessing, Introducing, or Aiding and Abetting the Entry of Contraband Inside Such Facilities”, gagamit ng handheld at walk-through metal detectors, x-ray scanners, K-9 units at ng iba pang makabagong teknolohiya.

Sakop ng panukala ang lahat ng correctional facilities na pinatatakbo ng Bureau of Corrections (Bucor), custodial facilities at detention facilities na minamantine ng provincial governments, Bureau of Jail Management and Penology (BJMP), Philippine National Police (PNP), National Bureau of Investigation (NBI), at iba pang pasilidad na ginagamit ng mga indibiduwal na deprived of liberty (PDL).

“This definition specifically includes ammunitions, firearms, and other weapons defined under the “Comprehensive Firearms and Ammunition Regulation Act” (RA 10591), explosives or incendiary devices as defined in PD 1866, dangerous drugs, illegal substances, equipment and paraphernalia as defined in the Comprehensive Dangerous Drugs Act of 2002 (RA 9165), alcohol or intoxicating beverage, cigarettes, tobacco products, and vapes, as defined under the “Vaporized Nicotine and Non-Nicotine Products Regulation Act” (RA 11900), all forms of currency and monetary instruments, electronic communication devices, signal jammers, luxury items such as appliances, gambling or gaming equipment, jewelry, and any other object that is capable of threatening the safety, security or health of persons inside or around the detention facility or correctional institution, or that is capable of being used in planning, aiding or executing the escape from such facilities or institutions,” sabi pa ni Barbers.

Nilalayon din ng panukala na ipataw ang parusang pagkakulong mula dalawampung (20) taon at isang (1) araw hanggang apatnapung (40) taon at multang hindi bababa sa P5,000,000.00 ngunit hindi hihigit sa P10M sa sinumang tao na magpakilala, maghahatid o magtangkang magpakilala o maghatid ng mga illegal na droga, baril, at pampasabog o sa mga mahuhuli sa pag-aari nito sa isang pasilidad ng bilangguan.
