Hinamon ni Cagayan de Oro City 2nd District Rep. Rufus Rodriguez ang bagong talagang Maharlika Investment Corp. (MIC) president at chief executive officer Rafael Consing Jr. na tugunan ang isyu na kinasasangkutan nitong kasong fraud/estafa na kinaharap nila ng kanyang ina.
Bagama’t iginiit ni Consing sa isang pahayag na na-dismiss na ang kaso, hindi nito sinabi kung kailan ibinasura ang reklamo at kung aling korte ang tuluyang naglabas nito.
“I am urging him to provide or disclose all of the details, and to show proof of dismissal so that all concerns about his qualification to head the government corporation that will manage tens of billions in assets of the Maharlika Investment Fund (MIF) will be resolved,” ayon kay Rodriguez.
Binanggit nito na ang mga naturang alalahanin ay lumabas sa social media ng mga taong nagmamalasakit sa integridad ng MIC at MIF at ang mga kwalipikasyon ng mga indibidwal na magpapatakbo sa korporasyon at mamamahala sa investment o sovereign fund.
Sinabi ni Rodriguez na ang mga alituntunin at regulasyon na nagpapatupad ng Republic Act No. 11954, ang batas na lumilikha ng MIF, ay nagdi-disqualify sa isang tao mula sa pagkakatalaga sa MIC board of directions limang taon bago ang kanyang appointment tulad ng:
*If the appointee was convicted by final judgement of an offense punishable by imprisonment of more than six years.
*If he was found administratively liable for any offense involving fraudulent acts.
*If he was convicted by final judgment or found liable by a foreign court or equivalent foreign regulatory authority for acts, violations, or misconduct.
*If the person has a pending administrative, civil or criminal case relating to fraud, plunder, corrupt practices, money laundering, tax evasion, or any similar crimes involving misuse of fund in the person’s possession or breach of trust.
Sinabi ni Rodriguez na mahalagang linawin ni Consing kung kailan na-dismiss ang kasong fraud/estafa at anumang kaugnay na reklamong kinasasangkutan nito at ng kanyang ina at magbigay ng pruweba ng dismissal dahil sa mga kondisyong itinakda ng rules and regulations sa qualifications ng MIC appointees.
“If the complaint has been thrown out five years before his appointment, then he is qualified. If the case was resolved with finality within the five-year period or if it is still pending, then he clearly is disqualified,” aniya.
Sinabi ni Rodriguez na sa Supreme Court E-Library lists ang kasong “G.R. No. 161075. July 15, 2013,” na naglalaman ng reklamong fraud/estafa laban kay Consing at sa ina nito.
Ang desisyon ng kaso ay isinulat ni dating chief justice at ngayon ay Executive Secretary Lucas Bersamin.
“Even if respondent is declared merely an agent of his mother in the transaction involving the sale of the questioned lot, he cannot be adjudged free from criminal liability. An agent or any person may be held liable for conspiring to falsify public documents. Hence, the determination of the issue involved in Civil Case No. SCA 1759 for Injunctive Relief is irrelevant to the guilt or innocence of the respondent in the criminal case for estafa through falsification of public document,” ayon sa desisyon.
“Maybe, the Supreme Court, through its spokesman, can tell the public when this particular case and related complaints against Mr. Consing were dismissed, and if there is still any pending,” sabi pa ni Rodriguez.
