Pag-amiyenda sa 1987 Constitution hindi makabubuti sa bansa — ex Chief Justice Davide

Mismong si retired Chief Justice Hilario Davide Jr. na ang nagsabing sa halip na makabuti ay mas makasasama ang planong pag-amiyenda sa 1987 Constitution.

Sa unang pagdinig ng Senate Committee on Constitutional Amendments and Revision of Codes, na pinamunuan ni Senador Sonny Angara, na tumalakay sa subcommittee on Resolution of Both Houses No. 6, sinabi ni Davide na walang sapat na dahilan para amiyendahan ang 1987 Constitution na mistulang sayaw ng cha-cha na magdadala sa hukay.

“Our problems are not due to the restrictive economic provisions of the Constitution. They cannot be solved by removing these restrictive economic provisions and completely leaving to Congress the future under the clause ‘unless otherwise provided by law,’” ayon kay Davide, na naging miyembro ng 1986 Constitutional Commission na bumuo sa Konstitusyon.

Aniya, ang pag-amiyenda sa ilang economic provisions ay magdadala lang ng mas seryoso at malaking problema sa bansa.

“On the contrary, they would create more serious and disturbing problems and consequences,” aniya.

“Amendment to or revision of the Constitution at this time will be lethal experiment, a fatal leap, o plunge to death, a leap to hell. It will be a cha cha dance to the grave or to hell,” ayon pa sa ex-Chief Justice.

Nabatid na isinagawa ang public hearing sa RBH 6, na naglalayong amiyendahan ang ilang economic provisions ng 1987 Constitution partikular ang Articles XII, XIV at XVI kabilang ang public services, education, at advertising industry.

Binigyan-diin ni Davide na ang kailangan ngayon ng bansa at ng mga Pilipino ay hindi mga susog o rebisyon ng Konstitusyon, kundi ang ganap na pagpapatupad ng mga prinsipyo at patakaran ng estado nito.

Samantala, sinabi ni House Deputy Minority leader at ACT Teachers party-list Rep. France Castro na sang-ayon ito sa pahayag ni Davide.

“Yes, I agree with former Chief Justice Davide considering that any Charter change now whether economic or political would be an open opportunity for foreign powers like the US and China to exploit to their advantage,” aniya.

“Cha-cha now could mean losing the resources for our next generation. It would be best to drop Charter change now and concentrate on the true problems of our people. Sa totoo lang, kahit anong paraan ng voting pa man “yan, kahit anong mode, di cha-cha ang dapat atupagin ng administrasyon at Kongreso ngayon,” dagdag nito.
