Inaprubahan na ng House Committee on Ways and Means ang mga probisyon sa buwis ng dalawang substitute bills na naglalayong ilibre sa buwis ang hazard pay ng mga public prosecutors, gayundin ang mga hukom ng iba’t ibang regional, metropolitan at municipal trial courts sa buong bansa.
Ang unang substitute bill, ay pinagsamang HBs 7775 na iniakda nina Speaker Ferdinand Martin Romualdez, Majority Leader Manuel Jose “Mannix” Dalipe, Senior Deputy Majority Leader at Ilocos Norte Rep. Ferdinand Alexander Marcos, at Tingog Party-list Reps. Yedda Marie Romualdez at Jude Acidre.
Ang HB 1835 ni Davao de Oro Rep. Ruwel Peter Gonzaga; at HB 8364 na inihain ni Cagayan de Oro City Rep. Rufus Rodriguez.
Ang mga naturang panukala ay naglalayong gawaran ang mga prosecutors ng tax-free hazard pay.
Ang tax provision na nakasaad sa Section 5 ng substitute bill ay nagsasabing “the hazard pay is not subject to tax and nothing in the measure shall be construed to diminish, in any manner, any benefit granted to duly appointed public prosecutors under existing laws, rules and regulations, local ordinances and other issuances.”
Sa explanatory note ng HB 7775, ipinaliwanag ni Romualdez na gumaganap ng napakahalagang papel ang mga public prosecutors sa paggagawad ng criminal justice.
Aniya, ang mga prosecutors ay pangunahing responsable sa paunang imbestigasyon at paglilitis ng lahat ng mga kasong criminal.
“They safeguard the fundamental rights of the persons involved in criminal proceedings and ensure public security. In the performance of their functions, they are assigned to investigate and prosecute cases involving national security, dangerous drugs, terrorism, and notorious criminals. As a consequence of their duties and exposure to hazardous situations, many prosecutors have received death threats, and a number of them have been killed in the line of duty,” ayon sa lider ng Kamara.
Sinabi ni Romualdez na ang mapanganib na tungkulin ng mga prosecutors, tulad ng pagsasagawa ng inquest proceedings, preliminary investigation at paglilitis sa mga masalimuot at mga high-profile na krimen ay naglalagay sa kanila sa panganib, kaya’t dapat lamang na gawaran ang mga ito ng hazard pay.
Sinabi naman ni Albay Rep. Joey Sarte Salceda, chairman ng komite, na ang paggagawad sa mga prosecutors ng premium hazard pay ay para sa panganib na walang pinag-iba sa pagbabayad sa kanila sa kanilang pagsisikap.
“Some have risks. Others have more risks than others. There should be a differentiation based on risk. It’s so simple. As the chair of this committee, I always subscribe that there must be some more existential philosophy that should guide the way we do our taxation,” ani Salceda.
Nanindigan ang Chief Prosecutors Association na ang hazard pay ay hindi suweldo, kundi kabayaran para sa proteksyon ng mga prosecutors at hindi dapat patawan ng buwis.
Kaugnay nito, inaprubahan ng komite ang probisyon sa buwis ng substitute bill sa HB 1836, na naggagawad ng hazard pay sa mga hukom ng Regional Trial Courts, Metropolitan Trial Courts, Municipal Trial Courts in Cities, Municipal Circuit Trial Courts at Municipal Trial Courts, at paglalaan ng pondo para dito.
