Inaprubahan na ng House Committee on Ways and Means sa Kamara na pinamumunuan ni Albay Rep. Joey Sarte Salceda ang mga probisyon sa buwis ng dalawang substitute bills na naglalayong isulong ang paglago at kaunlaran ng social enterprises bilang pamamaraan upang makaangat sa kahirapan, sa pamamagitan ng pagtatatag ng Poverty Reduction sa Social Entrepreneurship Program.
Kabilang na ang pagtatatag ng information and communications technology hubs sa buong kapuluan.
Ayon kay Bukidnon Rep. Jose Manuel Alba, isa sa mga may-akda ng unang substitute bill, layon ng panukala na maging kampyon sa social enterprises at social entrepreneurs, bilang kapartner ng pamahalaan sa pagtugon sa matagal nang suliranin sa kahirapan sa bansa.
“The primary stakeholder in this particular bill that the social enterprise seeks to help is the poor. This bill seeks to provide more attention to our social enterprise sector since they perform a very important role in addressing poverty in our country. Social enterprises are mandated to plough back 60 percent of their net income into the pursuit of their social mission. This is not an ordinary business, it is a business that supports a particular mission which is to address poverty,” ani Alba.
Pinagtibay ng lupon ang mga probisyon sa buwis na inirekomenda ng committee on Micro, Small and Medium Enterprises, na inendorso at ibinigay ang substitute bill, partikular na ang Section 3 na nagsasaad ng (a) which provides that for the purpose of the measure, the term “assets” shall mean “all kinds of properties, real or personal, owned, possessed, or used by the social enterprise (SE) for the conduct of its business.”
Gayundin ay pinagtibay ang Section 25 hinggil sa tax credits, ayon sa istilo.
Isinasaad rito na, “Social enterprises that hire employees based on either Community-Based Monitoring System (CBMS) or Proxy Means Test shall be entitled to an additional deduction from gross income equivalent to 25% of the total amount paid as salaries and wages to the said employees, subject to the provision of Section 34 of the National Internal Revenue Code of 1997, as amended.”
Isinasaad din dito na ang Department of Social Welfare and Development (DSWD) sa kanilang pakikipag-ugnayan sa mga may-kaugnayang ahensya, ay mag-iisyu ng mga karampatang tuntunin para sa pagpapatupad ng nasabing probisyon.
Ang panukala ay pumalit sa mga House Bills 2112, 4566, 4911, 5554, 6091, 6952 at 8192 na iniakda nina Reps. Luis Raymund ‘LRay’ Villafuerte Jr., Bernadette ‘BH’ Herrera, Gus Tambunting, Jose Manuel Alba, Maximo Dalog Jr., Eduardo ‘Bro. Eddie’ Villanueva at Mario Vittorio ‘Marvey’ Mariño, ayon sa pagkakasunod.
Inaprubahan din ng lupon ang probisyon sa buwis ng substitute bill na ipinadala ng Committee on Information and Communications Technology, na naglalayong magtayo ng ICT hubs sa buong bansa.
Ayon sa Section 8 ng panukala, na inamiyendahan, ang anumang rehistradong business enterprise (RBE) sa ICT hub ay maaaring gawaran ng mga insentibo, ayon sa performance-based, targeted, time-bound at transparent incentives regime na nakasaad sa ilalim ng Title XIII (Tax Incentives) ng National Internal Revenue Code of 1997, na inamyendahan.
“Provided that these incentives shall be granted, in addition to the incentives given by the local government unit (LGU) where such ICT hubs are located.”
Isinasaad din sa Section 8 na itatatag ng Philippine Economic Zone Authority (PEZA) ang ICT Parks and Centers at ang mga maaaring itatag sa hinaharap, ay gagawaran din ng mga insentibo, na manggagaling sa lokal na pamahalaan, kung saan naroroon ang mga ICT hubs.
Sa kanyang sponsorship speech, sinabi ni Negros Occidental Rep. Francisco “Kiko Benitez, isa sa mga pangunahing may-akda ng substitute bill, na kinakailangan ng bansa na magtatag ng mas maraming digital learning at incubation hubs, upang makaangkop ang mga learners, entrepreneurs at workers ng bansa sa mga pangangailangan ng digital learning, digital economy at digital jobs.
Pinalitan ng panukala ang mga HBs 70, 377, 2942, 4140, 4332, 4955, 5673, 6564, 7249 at 8052 na iniakda nina Benitez, Maria Rachel Arenas, Joseph ‘Jojo’ Lara, Harris Christopher Ongchuan, Linabelle Ruth Villarica, Keith Micah ‘Atty. Mike’ Tan, Paolo Duterte, Joseph Gilbert Violago, Rudys Caesar I Fariñas atMidy Cua, ayon sa pagkakasunod.
