Pagsuspende sa NCAP dapat lang – Rep. Barbers

Kinalampag ni Surigao del Norte Rep. Robert Ace Barbers ang Metro Manila Development Authority (MMDA), Land Transportation Office (LTO) at sa apat na local government units (LGUs) sa Metro Manila na ipatigil ang implementasyon ng No Contact Apprehension Policy (NCAP).

Ayon kay Barbers, chairman ng House Committee on Dangerous Drugs, dapat na pag-aralan ng mga nasabing ahensya ng pamahalaan at ng lokal na pamahalaan ng Manila, Quezon City, Paranaque at Valenzuela ang Memorundum of Agreement (MOA) na nilagdaan ng mga ito.

“The mounting complaints against NCAP implementation necessitate the review of all contracts and MOAs to determine their constitutionality,” sabi ng mambabatas.

Una nang sinabi ni Barbers na may malpractice sa pagpapatupad ng NCAP matapos na makatanggap ng mga ulat at reklamo mula sa mga motorista  partikular ang mga motorbike drivers na kabilang sa mga delivery services na inirereklamo ang malaking multa nang walang due process.

Sa ilalim ng NCAP system, ang MMDA/LGUs ay naglalabas ng notices/citation at pinapadala sa pamamagitan ng koreo  sa mga may-ari ng sasakyan.

Sakaling hindi mabayaran sa loob ng 7-araw ang paglabag o huli ay hindi papayagang sumailalim sa re-registration ng LTO.

Sinabi pa ni Barbers na ang pagpapatupad ng NCAP implementation ay mas marami ang idinulot na katanungan sa halip na kasagutan sa problema sa trapiko.

“This NCAP system laudable since the intent is to discipline erring, abusive or wayward drivers. But the implementors, I was told, are imposing excessive fines and could be violating the Constitution since there is no due process of law. And there is no law, ordinance or regulation prohibiting vehicle registration due to non-payment of fines for traffic violations,” paliwanag ni Barbers.

“I learned from a friend that he got an NCAP “hit”, one from Paranaque and four in Manila, and was forced to pay more than P14,000 because his vehicle won’t be re-registered by the LTO until he settles all the fines due him. He has receipts to prove it. Para siyang hostage sa isang traffic entrapment operation,” sabi pa nito.
