Dapat na ibalik ng mga anim na local government units (LGUs) na nagpatupad ng no-contact apprehension policy (NCAP) ang perang ibinayad ng mga motoristang pinagmulta ng mga ito dahil sa paglabag sa batas-trapiko.
Ito ang giit ni 1-Pacman party list Rep. Mikee Romero kasunod ng inilabas na temporary restraining order (TRO) ng Korte Suprema sa NCAP dahil sa kawalan ng sapat na pag-aaral sa ipinatupad na programa ng mga LGUs at ng Metro Manila Development Authority (MMDA), at Land Transportation Office (LTO).
“Now that the Supreme Court has issued a TRO (temporary restraining order) against this policy, the concerned agencies and LGUs should reimburse the alleged violators the fines collected from them,” sabi ni Romero.
Sinabi pa nito na malaking pera ang nakolekta ng mga nasabing ahensya ng pamahalaan mula sa NCAP offenders kung kaya’t dapat na ibalik ito sa mga pinagmulta.
Ayon pa kay Romero, ilang residente ng Quezon City ang naging biktima ng NCAP violations sa ipinatutupad na 60-kilometer-per-hour speed limit sa kahabaan ng Commonwealth Avenue.
“The notices show that the alleged violations were just 1-2 minutes apart. The video footage showing the alleged offenses must have been taken by just one camera. This is proof that this scheme is open to abuse,” ayon pa sa kongresista.
Paliwanag pa ni Romero, ang mga biktima ay walang naging proteksyon laban sa pang-aabuso ng NCAP dahil sa hindi na makakapagreklamo ang mga ito base sa kuha ng CCTV.
Sinabi pa ni Romero dapat papanagutin ang LTO na nagbigay ng pagkakakilanlan at pangalan ng lumabag sa batas-trapiko sa MMDA at LGUs.
“The LTO might have violated the Data Privacy Act by disclosing this personal information, which it is bound under the law to protect. I hope the data does not fall into the hands of criminally-inclined persons who could use it for extortion activities,” giit pa ng kongresista.
