Isinusulong sa Mababang Kapulungan ng Kongreso ang panukalang batas na naglalayong maprotektahan ang taumbayan sa mga pekeng produkto partikular ang piyesa at accessories ng mga motorsiklo.
Sa House Bill No. 6445 o ang “The Aftermarket Motorcycle Parts and Accessories Retail Protection Act” na inihain ni 1-Rider party-list Ramon Rodrigo “Rodge” Gutierrez layon nitong tiyakin na ang lahat ng produkto na ibinebenta sa publiko na motorcycle parts ay sumusunod sa kasalukuyang mga regulasyon ng Land Transportation Office (LTO).
Ipinaliwanag ni Gutierrez na ang House Bill No. 6445 ay nagmumungkahi na hilingin sa mga retailers ng aftermarket motorcycle parts and accessories ay mag-iisyu ng warranty at reimburse sa kanilang mga customer kung ang mga bagay na ibinenta ay napatunayang hindi sumusunod sa mga regulasyon ng LTO.
Paliwanag ng kongresista na ang piyesa at accessories ng mga motorsiklo ay nagpapahusay sa kaligtasan, performance o ginhawa ng isang motorsiklo, ngunit hindi limitado sa mga windscreen, gulong, preno, side mirror, head light, turn signal, muffler, air filter at motorcycle stand, na binili at na-install ng may-ari ng motorsiklo post-sale.
“The LTO has released several issuances specifying the required standards of aftermarket parts and accessories before the installation of the same in a motorcycle. However, buyers of these aftermarket parts and accessories are sometimes met with apprehensions by traffic enforcers or confiscation of the parts or accessories during the annual inspection for motor vehicle registration, with the inspectors claiming that these are not compliant with LTO regulation, at the loss of the buyer,” ayon sa panukalang batas.
“If the aftermarket parts and accessories are not compliant with LTO regulation, why then are retailers offering these for sale? Potential buyers are given the impression that since retailers are selling certain aftermarket parts and accessories, then these are permitted by law. However, such is not always the case and this measure seeks to address this concern,” sabi pa ni Gutierrez.
Ayon kay Gutierrez, ang panukalang batas ay naglalayon din na atasan ang mga retailer na tiyakin na maayos na pag-install ng mga piyesa at accessories ng motorsiklo, alinsunod sa mga regulasyon ng LTO, kung ang mamimili ay humiling ng mga serbisyo sa pag-install.
Nakasaad sa Section 5 ng panukalang batas na nagmumungkahi na sa pagbebenta ng bawat item, ang mga retailer ay dapat mag-isyu ng isang nakasulat na express warranty ng pagsunod sa regulasyon ng LTO sa lahat ng aftermarket motorcycle parts at accessories ng motorsiklo na ibinebenta, at isang kopya ay dapat ibigay sa bumibili kasama ang official receipt.
Idinagdag nito na dapat ipakita ang express warranty at ang petsa ng pagbebenta, partikular na regulasyon ng LTO na may bisa na sumasaklaw sa lahat ng mga bagay na ibinebenta at ang partido na responsable para sa pag-install ng mga item.
“However, should the written express warranty shows that either the aftermarket parts and accessories were compliant with LTO regulations at the time of the sale or the party responsible for installing the parts and accessories was not the seller, the buyer shall bear the loss,” ayon sa panukala.
Sa ilalim ng panukalang batas, ang Department of Trade and Industry (DTI), sa pakikipag-ugnayan sa LTO, ang magiging pangunahing ahensya ng gobyerno na magbabantay sa pagpapatupad ng batas.
