5 negosyante kinasuhan ng BIR sa DOJ

Sinampahan ng kaso ng Bureau of Internal Revenue (BIR) sa tanggapan ng Department of Justice (DOJ) ang limang negosyante na sangkot sa smuggling at hindi pagbabayad ng kaukulang buwis.

Pinangunahan ni BIR Commissioner Romeo D. Lumagui, Jr., kasama ang revenue officers mula sa BIR Manila District Office No. 32 ang paghahain ng kaso sa DOJ laban sa mga negosyanteng sina Wei Feng Bao aka Sofi Chua, Christina M. Poa, Sandoval Severino Briones, Jimy Go, at Bibiano P. Lesaca.

Kasong “Unlawful Possession or Removal of Articles Subject to Excise Tax Without Payment of the Tax na naaayon sa Section 263; Selling of Heated Tobacco Products and Vapor Products at a Price Lower Than the Combined Excise and Value-Added Taxes in violation of Section 263-A; Selling or Offering for Sale Any Box or Package Containing Articles Subject to Excise Tax with false, spurious or counterfeit stamps or labels or selling from any such fraudulent box, package or container as aforementioned in violation of Section 265, all amended by Republic Act (R.A.) No. 11346, and further amended by R.A. No. 11467; Willful Attempt to Evade or Defeat Tax in violation of Section 254;  Willful Failure to Pay Taxes in violation of Section 255, in relation to Sections 15, 171, 172 and 253 (d), all of the National Internal Revenue Code of 1997, as amended.”

Sa record, si Feng Bao ang may-ari ng bank account kung saan idineposito ang bayad sa online purchase sa internet platform. 

Gayundin, si Poa ang proprietress ng ROCKET BULL MARKETING na may tanggapan sa Unit 1G, 763, Soler St., cor. Sales St., Zone 30, Quiapo, Manila habang si Briones ang proprietor ng SBS MOTORCYCLE PARTS AND ACCESSORIES na may tanggapan sa Unit 1G, 637, Soler St., cor.  Sales St., Zone 30, Quiapo, Manila. 

Samantala, ang respondent na si Go ang proprietor ng TAP FOG PHILIPPINES na matatagpuan sa Acasel Building, Sales cor. Soler St., Quiapo, Manila at si Lesaca naman ay owner/lessor ng Acasel Building, na isang three-story commercial building sa  1 Lincoln St., Greenhills, San Juan City kung saan natagpuan ang mga excisable articles.

Nag-ugat ang kaso mula sa covert operation/inspection na patagong itinago ang business operations sa Acasel Building, Sales cor. Soler St., Quiapo, Manila, na ang SBS Motorcycle Parts and Accessories ang umookupa.

“Pursuant the relevant information gathered from the covert operation/inspection and subsequent test buy conducted, Mission Orders (MOs) were issued by Revenue Region No. 6 – Manila directing Revenue Officers of Revenue District Office No. 32 – Sampaloc/Sta. Mesa/Quiapo to conduct verification, sales monitoring, inventory taking, surveillance and seizure activities in Acasel Building, Sales cor. Soler St., Quiapo, Manila,” ayon sa BIR.

Kasama ng BIR na nagsagawa ng operasyon ang Philippine National Police at Barangay officials, Regional Director Albino M. Galanza at Assistant Regional Director Saripoden M. Bantog, kung saan natuklasan ang 899 boxes ng untaxed excisable articles na binubuo ng 175,050 pirasong PODS at 61,400 piraso ng bottled flavored juice na nakuha sa Acasel Building na pag-aari ni Lesaca.

Dahil sa mga paglabag, pinagbabayad ng BIR ang mga akusado ng kabuuang P1,240,748,088.63, kasama na ang multa.

Ayon sa BIR ang kaso laban sa mga akusado ang kauna-unahan sa ilalim ng Run After Tax Evaders (RATE) Program ng ahensya  sa ilalim ng pamumuno ni Lumagui at ni Revenue Region 6-Manila Regional Director Albino M. Galanza.

“I hope this serves yet another warning to those who think that they can continue to evade the payment of their taxes. We are hands-on and focused in our job, and we take this very seriously,” ayon kay Lumagui.
